Welcome to SYNTHESIS, an AI-powered software development platform operated by OrzattyStudios ("SYNTHESIS," "we," "our," or "us"). These Terms of Service ("Terms") constitute a legally binding agreement between you and SYNTHESIS governing your access to and use of the SYNTHESIS platform at synthesisai.pages.dev and all related services, features, content, and applications (collectively, the "Services").

1. Acceptance of Terms

By accessing or using the Services, you represent and warrant that:

• You are at least 16 years of age (or the age of majority in your jurisdiction, whichever is higher)
• You have the legal capacity and authority to enter into a binding agreement
• You are not prohibited from using the Services under the laws of your jurisdiction
• If you are accepting these Terms on behalf of an organization, you have the authority to bind that organization to these Terms
• You will comply with these Terms and all applicable local, state, national, and international laws and regulations

2. Description of Services

SYNTHESIS provides an AI-powered software development platform that includes:

• AI Coding Agents: Multi-agent AI system capable of autonomous code generation, review, debugging, and optimization across multiple programming languages and frameworks
• Integrated Development Environment: Browser-based code editor with syntax highlighting, intelligent autocomplete, and real-time collaboration features
• Code Execution: Secure sandboxed environments for running and testing code
• Project Management: Tools for organizing, versioning, and managing software projects
• Deployment Services: Integration with hosting platforms for deploying applications
• Third-Party Integrations: Connections to external services such as GitHub, version control systems, and cloud providers

We reserve the right to modify, suspend, or discontinue any aspect of the Services at any time, with or without notice. We will make reasonable efforts to notify users of significant changes.

3. Account Registration and Security

3.1 Account Creation

To access certain features of the Services, you must create an account. When creating an account, you agree to:

• Provide accurate, current, and complete registration information
• Maintain and promptly update your account information to keep it accurate and current
• Choose a strong, unique password and keep it confidential
• Not share your account credentials with any third party
• Not create more than one account per person unless expressly permitted

3.2 Account Security

You are solely responsible for:

• Maintaining the confidentiality of your account credentials
• All activities that occur under your account, whether or not authorized by you
• Notifying us immediately at orzattystudios@gmail.com of any unauthorized use or security breach

We are not liable for any loss or damage arising from your failure to protect your account credentials.

4. Intellectual Property Rights

4.1 Your Content and Code

• All code you write, upload, or generate using our AI agents belongs exclusively to you
• You may use, modify, distribute, license, or sell your code without restriction, subject to any applicable third-party licenses
• We do not use your code or projects to train our AI models

4.2 License to SYNTHESIS

By using the Services, you grant SYNTHESIS a limited, non-exclusive, worldwide, royalty-free license to:

• Host, store, and backup your content on our servers and infrastructure
• Process your content as necessary to provide the Services (including AI code generation and analysis)
• Display your content to you and anyone you authorize through sharing features
• Transmit your content to third-party services you have connected (e.g., GitHub, deployment platforms)

This license terminates when you delete your content or close your account, except for content that has been shared with others or deployed to external services.

4.3 AI-Generated Code

Code generated by our AI agents based on your prompts, specifications, and project context:

• Belongs to you and may be used without restriction for any purpose
• May incorporate patterns, structures, or techniques derived from publicly available code and documentation
• May be subject to third-party licenses if it incorporates specific open-source libraries or frameworks (you are responsible for compliance)
• Is provided "as is" and should be reviewed and tested before use in production

4.4 SYNTHESIS Intellectual Property

The SYNTHESIS platform, including its software, algorithms, AI models, user interface, design, branding, documentation, and all related intellectual property, is owned by OrzattyStudios and protected by intellectual property laws. You may not:

• Copy, modify, adapt, or create derivative works of the SYNTHESIS platform
• Reverse engineer, decompile, disassemble, or attempt to derive the source code of our software
• Use the SYNTHESIS name, logo, or trademarks without prior written permission
• Remove, alter, or obscure any proprietary notices, labels, or marks
• Sublicense, sell, resell, transfer, or distribute the Services

5. Acceptable Use Policy

5.1 Permitted Use

You may use the Services for lawful software development purposes, including personal projects, commercial applications, educational purposes, and open-source contributions.

5.2 Prohibited Activities

You agree NOT to use the Services to:

• Create Malicious Software: Generate malware, viruses, ransomware, spyware, botnets, or any code designed to damage, disrupt, or gain unauthorized access to systems
• Infringe Intellectual Property: Copy, reproduce, or generate code that infringes on patents, copyrights, trademarks, or other intellectual property rights of third parties
• Engage in Fraud: Create phishing sites, scam applications, or tools designed to deceive or defraud others
• Violate Laws: Engage in any activity that violates applicable local, state, national, or international laws
• Harm Others: Harass, abuse, threaten, stalk, or otherwise harm other users or third parties
• Generate Harmful Content: Create code that produces illegal content, hate speech, or content that exploits minors
• Circumvent Security: Attempt to bypass, disable, or interfere with security features, access controls, or usage limits
• Disrupt Services: Interfere with or disrupt the Services, servers, or networks connected to the Services
• Unauthorized Access: Access or attempt to access accounts, systems, or data that you are not authorized to access
• Excessive Usage: Use automated scripts, bots, or other means to access the Services in a manner that exceeds normal human usage or circumvents rate limits
• Competitive Intelligence: Use the Services to develop a competing product or for competitive benchmarking
• Misrepresentation: Impersonate any person or entity or misrepresent your affiliation with any person or entity

5.4 Anti-Abuse and Banning Policy ("Military Grade Shield")

To ensure system stability, the following strict measures are enforced by our automated security core:

• Automated IP Logging: We log and monitor all IP addresses in real-time. By using the Services, you acknowledge and consent to this logging for security and infrastructure protection.
• Standard Abuse (The 5-Strike Rule): Repeated minor violations (failed login attempts, invalid registration codes, or excessive standard requests) will trigger a 7-day account and IP ban upon reaching 5 strikes.
• Critical Attack (Immediate Permanent Ban): Any single request containing 5 or more malicious patterns (including but not limited to SQL Injection, XSS, or Command Injection) will result in an immediate and permanent IP block.
• Infrastructure Protection (DDoS): If an IP address exceeds **100 requests within a 10-second window**, it will be classified as a Denial of Service (DDoS) attack and will be **permanently blacklisted at the network level**.
• Quantum Protective Layer: All security signals and logs are protected by our QuantumShield (AES-256-GCM) to prevent tampering and ensure evidence integrity.

5.5 Usage Limits and Single Project Policy

During Beta, users are restricted to one active project at a time. Attempting to bypass this limit via multiple accounts or automation is a direct violation of these Terms and will result in a strike against your account.

6. Subscription Plans and Payment

6.1 Free Tier

SYNTHESIS offers a free tier with limited access to features and usage limits. Free tier users are subject to:

• Daily limits on AI agent interactions and code generation requests
• Project storage limitations
• Limited access to advanced features
• Community-based support only

6.2 Paid Subscriptions

Premium features and increased limits require a paid subscription. By subscribing, you agree to:

• Pay all applicable fees according to the pricing displayed at the time of purchase
• Authorize recurring charges to your payment method for subscription renewals
• Provide accurate and complete billing information
• Keep your payment information current and valid

6.3 Billing and Renewal

• Monthly Plans: Billed on the same date each month. Your subscription automatically renews each month until cancelled.
• Annual Plans: Billed once per year. Your subscription automatically renews each year until cancelled.
• Price Changes: We may change subscription prices upon 30 days' notice. Price changes apply to the next billing cycle.
• Taxes: All prices are exclusive of applicable taxes unless stated otherwise. You are responsible for paying any taxes.

6.4 Cancellation

• You may cancel your subscription at any time through your account settings or by contacting orzattystudios@gmail.com
• Cancellation takes effect at the end of the current billing period
• You retain access to paid features until the end of your paid period
• We do not provide prorated refunds for unused portions of monthly subscriptions

6.5 Refund Policy

• Monthly Subscriptions: No refunds for partial months. You may cancel before renewal to avoid future charges.
• Annual Subscriptions: Eligible for a full refund within 30 days of initial purchase or renewal ("30-day money-back guarantee"). After 30 days, no refunds are provided.
• Refund Requests: Contact orzattystudios@gmail.com with your refund request, including your account email and reason for the request.
• Exceptions: Refunds may be denied if we determine the refund request is made in bad faith or after substantial use of the Services.

6.6 Failed Payments

If a payment fails, we will attempt to charge your payment method again. If payment continues to fail, your subscription may be suspended or downgraded to the free tier. You remain responsible for any unpaid amounts.

7. Third-Party Services and Integrations

The Services integrate with third-party services including but not limited to GitHub, Stripe, Supabase, Cloudflare, Google, and OpenAI. Your use of these integrations is subject to the respective third-party terms of service and privacy policies.

• We are not responsible for the availability, accuracy, or reliability of third-party services
• Your interactions with third-party services are solely between you and the third party
• You are responsible for reviewing and complying with third-party terms
• Third-party services may collect data according to their own privacy policies

8. Disclaimers

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, SYNTHESIS DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO:

• IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT
• WARRANTIES THAT THE SERVICES WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE
• WARRANTIES THAT AI-GENERATED CODE WILL BE BUG-FREE, SECURE, COMPLETE, OR SUITABLE FOR ANY PARTICULAR PURPOSE
• WARRANTIES THAT THE SERVICES WILL MEET YOUR SPECIFIC REQUIREMENTS OR EXPECTATIONS
• WARRANTIES REGARDING THE ACCURACY, RELIABILITY, OR QUALITY OF ANY CONTENT, CODE, OR INFORMATION OBTAINED THROUGH THE SERVICES

YOU ARE SOLELY RESPONSIBLE FOR:

• Reviewing, testing, and validating all code (including AI-generated code) before deployment or use in production environments
• Ensuring that your use of the Services and any code produced complies with applicable laws and industry standards
• Backing up your code and data; we are not responsible for data loss
• Security vulnerabilities in code you deploy, regardless of whether it was AI-generated

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:

• NO INDIRECT DAMAGES: SYNTHESIS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA, OR OTHER INTANGIBLE LOSSES.
• NO LIABILITY FOR CODE: SYNTHESIS SHALL NOT BE LIABLE FOR ANY DAMAGES ARISING FROM THE USE, DEPLOYMENT, OR EXECUTION OF CODE GENERATED BY OUR AI AGENTS OR CREATED USING OUR PLATFORM.
• LIABILITY CAP: OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICES SHALL NOT EXCEED THE GREATER OF: (A) THE AMOUNT YOU PAID TO SYNTHESIS IN THE 12 MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED US DOLLARS ($100).

SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF LIABILITY FOR CONSEQUENTIAL OR INCIDENTAL DAMAGES, SO THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU.

10. Indemnification

You agree to defend, indemnify, and hold harmless SYNTHESIS, OrzattyStudios, and their respective officers, directors, employees, contractors, agents, licensors, and affiliates from and against any and all claims, damages, obligations, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from:

• Your use of the Services
• Your violation of these Terms or any applicable law
• Your violation of any rights of third parties, including intellectual property rights
• Code or content you create, deploy, or distribute using the Services
• Any dispute between you and a third party arising from your use of the Services

11. Account Suspension and Termination

11.1 Termination by You

You may terminate your account at any time by:

• Contacting us at orzattystudios@gmail.com with your account deletion request
• Using the account deletion feature in your account settings (when available)

11.2 Termination by SYNTHESIS

We may suspend or terminate your account and access to the Services immediately, without prior notice or liability, if:

• You breach any provision of these Terms
• You violate the Acceptable Use Policy
• We are required to do so by law or legal process
• Your conduct may harm other users, third parties, or SYNTHESIS
• Your account has been inactive for an extended period (12+ months for free accounts)
• We discontinue the Services or your region is no longer supported

11.3 Effect of Termination

Upon termination:

• Your right to access and use the Services ends immediately
• You may request export of your project data within 30 days of termination
• We may delete your account data and projects after 30 days
• Provisions that by their nature should survive termination will survive (including intellectual property rights, disclaimers, limitations of liability, and indemnification)
• You remain responsible for any unpaid fees or obligations incurred prior to termination

12. Modifications to Terms

We reserve the right to modify these Terms at any time. When we make material changes:

• We will update the "Last updated" date at the top of this page
• We will notify you via email and/or prominent notice on the platform at least 30 days before changes take effect
• Continued use of the Services after the effective date constitutes acceptance of the updated Terms
• If you do not agree to the updated Terms, you must stop using the Services and may terminate your account

13. Governing Law and Dispute Resolution

13.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law principles.

13.2 Informal Resolution

Before filing any formal dispute, you agree to first contact us at orzattystudios@gmail.com and attempt to resolve the dispute informally for at least 30 days.

13.3 Jurisdiction

Any legal action or proceeding arising out of or relating to these Terms shall be brought exclusively in the federal or state courts located in San Francisco County, California, and you consent to the personal jurisdiction and venue of such courts.

13.4 Class Action Waiver

TO THE EXTENT PERMITTED BY LAW, YOU AGREE THAT ANY CLAIMS MUST BE BROUGHT IN YOUR INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING.

14. General Provisions

14.1 Entire Agreement

These Terms, together with the Privacy Policy and Cookie Policy, constitute the entire agreement between you and SYNTHESIS regarding the Services and supersede all prior agreements and understandings.

14.2 Severability

If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

14.3 Waiver

The failure of SYNTHESIS to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.

14.4 Assignment

You may not assign or transfer these Terms or your rights under them without our prior written consent. We may assign these Terms without restriction.

14.5 Force Majeure

SYNTHESIS shall not be liable for any delay or failure to perform resulting from causes outside our reasonable control, including natural disasters, war, terrorism, strikes, or internet service failures.
